Leave Types in Malaysia
Employee Leave
Employee Leave, also known as Paid Leave, is a benefits for employees which enable employee to apply for “not attending” on working day. Leave is not considered as absent on work, it is a proper procedure for company’s employee by applying their leave to HR or HOD in order to “Leave” on that day.
Leave are usually applied by employee due to certain circumstances such as resting, employee personal issues (car maintenances, vacation etc), emergency event or other activities that related to employee.
Employee shall not apply their leave during company event such as annual dinner, team building etc.
Note that all of the employee is entitled for paid leave whether he or she is working in any industry or company. Employee’s leave entitlement are subject to follow the Employment Act 1955 Malaysia.

Annual Leave
Annual Leave is the most common leave that are entitled for most of the employee in HRMS Payroll Malaysia. It is an automatic renewed leave (some of the company are not) when begin a new year.
Meanwhile, employee Annual Leave are earned differently according to their working year of services. Which are the following:
Employee who worked less than 2 years: earned 8 days of annual leave (renew each year)
Employee who worked more than 2 years but less than 5 years: earned 12 days of annual leave (renew each year)
Employee who worked more than 5 years: earned 16 days of annual leave (renew each year)
For the above annual leave requirement stated shall be followed by all Malaysia companies, given to full year services employee. (Example, an employee begins a work on Jan)
For the above annual leave requirement stated shall be followed by all Malaysia companies, given pro ratio to the employee who didn’t serve a full year services. (Example, an employee begins a work on May)
Annual Leave Pro ratio calculation:
In order to having pro ratio to those employees who didn’t serve a full year services, the algorithm of pro ratio annual leave calculation is the following:
Employee Annual Leave x (service months / 12)
For an easy example in this case, Flexi was employed 2021 and began his work on July, he was entitled to 8 days of annual leave, he succeeds to service/ to be employed for 6 months. In this case he had a 4 days of annual leave after pro ratio annual leave calculation.
However, some of the companies provide more annual leave (than the annual leave stated above) to their employee, which is considered as an employee benefits.
Medical Leave (Sick Leave)
Medical Leave is also known as sick leave or MC in general, is applied by employee when they are having illness or uneasy. Employees are required to get a Medical Certificate (MC from doctor) as a proof of illness in order to apply for medical leave.
According to the employment act 1955 states that employee under the Act are entitled to:
Employee who worked less than 2 years: earned 14 days of medical leave (renew each year)
Employee who worked more than 2 years but less than 5 years: earned 18 days of medical leave (renew each year)
Employee who worked more than 5 years: earned 22 days of medical leave (renew each year)
Hospitalization Leave
Different from Medical leave, hospitalization leave is used for hospitalization purposed, the employee was having a serious illness or injured that have to be hospitalized.
If an employee gets a normal fever, he went to clinic and get a MC from doctor, he will be applied for Medical Leave.
If an employee gets a dengue fever, he has to stay in hospital for further checkup or monitoring, he will be applied for Hospitalization Leave.
Hospitalization Leave a fixed per year, unlike Annual Leave and Medical leave, an employee gets 60 days of hospitalization leave for every working year.
Maternity Leave
Maternity Leave is provided for all Malaysia female employee who are entitled for 60 days of consecutive Maternity Leave while giving birth. However, there is one condition for the Maternity Leave is:
The employee must have worked more than 90 days over the past 9 months, and the employee must have been employed within the 4 months leading up to the confinement period.
However, there is a new change of Maternity Leave since 2021, the Ministry of Human Resource has announced that employees in private sector (Sdn Bhd) are entitled up to 90 days of maternity leave, which same as the government sector.
